By using our websites, you agree to these Terms. If you do not agree, please discontinue use.
1. Website Use
You may use our websites for lawful purposes, including learning about our services and contacting us.
You agree not to:
Use our websites for unlawful, fraudulent, or harmful activities.
Submit false information, impersonate another person, or provide contact details you are not authorized to use.
Attempt to gain unauthorized access to our systems or other users’ information.
Introduce malicious software or interfere with website operation or security.
Copy or exploit website content in violation of applicable intellectual property rights.
2. Information and Service Inquiries
Website content provides general information about CREATE and our services. We make reasonable efforts to keep it accurate, but information may contain errors or become outdated.
Submitting a form, requesting information, or communicating with us does not by itself create a client relationship or bind either party to a project.
The scope, fees, payment terms, deliverables, timelines, and other conditions of paid services will be set out in a separate agreement. If that agreement conflicts with these Terms regarding the services, the separate agreement controls.
3. Contact Forms and Communications
When you submit a form, you agree to provide accurate information, including your first name, last name, email address, and phone number, as requested.
We may use those details to respond to your inquiry and communicate about the services you requested, subject to your preferences and applicable law.
Do not submit confidential or sensitive information through a website form unless we have agreed to an appropriate method for receiving it.
4. Text Messaging Terms
Program description. CREATE may send text messages from its business number to people who request or consent to text follow-ups. Messages may relate to inquiries, service information, appointments, proposals, or ongoing conversations.
Consent. We send text messages based on the consent you provide or as otherwise permitted by law. Agreeing to these Terms or submitting a form does not, by itself, constitute consent to receive automated marketing texts. We obtain any additional consent required for those messages.
Frequency and charges. Message frequency varies. Message and data rates may apply according to your wireless plan.
Opting out. Reply STOP to stop text messages. You may also request an opt-out by emailing info@createmarketing.io or calling (832) 481-6529. We may send a final confirmation of your opt-out.
Help. Reply HELP, email info@createmarketing.io, or call (832) 481-6529 for assistance.
Voluntary participation. Consent to receive text messages is not a condition of purchasing services.
Your phone number. Only provide a phone number you own or are authorized to use. Please notify us if you change or give up that number.
Delivery. Text delivery depends on wireless networks and other factors outside our control. Delivery may be delayed or unsuccessful. Wireless carriers are not liable for delayed or undelivered messages.
Information associated with text messaging is handled as described in our Privacy Policy.
5. Intellectual Property
Website text, graphics, logos, designs, images, and other content are owned by CREATE or used with permission and are protected by applicable intellectual property laws.
You may view our websites and download or print reasonable portions for personal use or internal evaluation of our services. This permission does not transfer ownership or authorize commercial redistribution, modification, or use of our branding without permission.
Third-party names and trademarks belong to their respective owners.
6. Third-Party Links and Services
Our websites may contain links to third-party websites or tools. We do not control those services or guarantee their availability, accuracy, security, or content. Your use of them is subject to their own terms and privacy policies.
7. Privacy and Cookies
Our Privacy Policy explains how we handle personal information, contact submissions, cookies, analytics, and communication preferences.
These Terms do not replace any separate consent required for cookies, text messages, or other processing.
8. Disclaimers
To the fullest extent permitted by applicable law, our websites and their content are provided “as is” and “as available,” without warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free access, complete accuracy of website content, or that the websites will be free from harmful components.
Descriptions of past projects, examples, or results do not guarantee a particular business or marketing outcome. Any commitments regarding paid services must be stated in the applicable service agreement.
9. Limitation of Liability
To the fullest extent permitted by applicable law, CREATE will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of or inability to use our websites.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or restricts rights that applicable law does not allow you to waive.
Liability relating to paid services is governed by the applicable service agreement.
10. Website Changes and Access
We may update, suspend, or discontinue website content or features. We may restrict access when reasonably necessary to address security issues, misuse, violations of these Terms, or legal requirements.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Subject to any mandatory legal rights, disputes arising from these Terms or website use will be brought in courts with appropriate jurisdiction in Harris County, Texas.
12. Changes to These Terms
We may revise these Terms from time to time. Revised Terms will be posted on this page with an updated date and will apply prospectively. We will provide additional notice where required by law.
